General Acceptance

The General Terms and Conditions (GTC) apply to all legal transactions via the WILI WILI TREE® online shop or WILI WILI TREE AG online shop. By placing an order (in the online shop or by email), the buyer accepts all provisions of these terms and conditions of sale and delivery. Contrary conditions are not accepted. WILI WILI TREE AG reserves the right to change these GTC at any time.

Conclusion of Contract
The purchase contract is concluded as soon as a paid order is placed in the online shop. Until this point, the products and prices in the online shop are considered an offer.

Dimensions and Illustrations, etc.
All information and illustrations in our online shop and on the website are non-binding. Model changes are reserved. Descriptions, technical specifications, and prices of the products are subject to change at any time. We reserve the right to make typographical or graphic errors, as well as errors in the product descriptions, prices, and technical information.

VAT
VAT is included in Swiss prices (in CHF). VAT is shown separately on the invoice.

Shipping
Delivery costs are added to the sales price for all products. This applies to deliveries within Switzerland (unless otherwise agreed) and the EU (European Union). WILI WILI TREE AG may offer promotions such as free shipping as a promotional offer – however, this is not a standard condition.

Customs Duties
For international shipments outside the EU or Switzerland, customs or import duties may be levied once they reach your destination. You are liable for all such duties and it is your responsibility to pay the fees for releasing the goods from the shipment. We are legally required to declare the full value of the shipment and will issue an invoice to customs if necessary.

Please note that the customer is responsible for paying any local customs duties. If duties are refused or not paid, they may be deducted from any future refund. Orders/shipments returned due to refusal or non-payment of customs duties will not be refunded by WILI WILI TREE. We have no influence on these fees, as customs regulations vary by country.

Delivery Times & Deliveries
Delivery times are provided by WILI WILI TREE AG as accurately as possible, but are always non-binding. If WILI WILI TREE AG is unable to meet a delivery date, the buyer is not entitled to cancel the order or assert any claims for damages. For WILI WILI TREE® products, the delivery time is 3-5 working days after receipt of the order (within Switzerland). If a product is in stock, the delivery time may be less. WILI WILI TREE AG is not liable for the timely delivery of a shipment. If the customer wishes to return the product, they must do so at their own expense. Otherwise, the outstanding or already paid amount remains due in full.

Payment Terms
Discounts, vouchers, and other deductions cannot be combined. Retention of title.

The goods remain the property of WILI WILI TREE AG until full payment has been made.

Complaints
The customer must immediately inspect delivered products for accuracy, completeness, and delivery damage. Any complaints regarding the quality, quantity of the delivered goods, or the invoiced amount must be reported to WILI WILI TREE AG immediately (no later than 10 days after receipt of the goods; otherwise, the goods are deemed to be in perfect condition and accepted) by email to hello@wiliwilitree.com. If the goods are returned to WILI WILI TREE AG despite applicable guidelines, WILI WILI TREE AG will not cover the costs. The buyer must immediately notify the shipping company that delivered the goods in writing and notify WILI WILI TREE AG of any transport damage (no later than 10 days after delivery; otherwise, the goods are deemed to be in perfect condition and accepted).

Warranty
We provide a warranty for materials for a period of 2 years from delivery of the goods. To report a warranty claim, please fill out the form. Any further warranty is expressly prohibited.

The warranty is excluded for damages resulting from normal wear and tear, improper use, or other fault of the buyer. Furthermore, the warranty is excluded if the customer or third parties have made repairs or modifications to the goods.

If the buyer asserts legitimate defects within the meaning of these provisions in writing, WILI WILI TREE AG has the option of repairing the defects or replacing the defective goods or parts thereof with new ones. The warranty period is not renewed or extended by any repair or replacement delivery.
Illustrations and descriptions of the goods on our (and/or our suppliers') online platform, brochures, and price lists are not binding for the design of the delivered goods; WILI WILI TREE AG and its suppliers reserve the right to make design changes, structural deviations, and other deviations at any time.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or country to country. WILI WILI TREE's liability is limited to incidental damages, which shall not exceed the purchase price of the product. WILI WILI TREE expressly disclaims any responsibility for indirect or consequential damages for any reason whatsoever, and any additional liability is excluded. This exclusion and limitation of liability apply regardless of the legal theory of damages and will remain in effect even if a claim fails of its essential purpose. Some states or countries do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Other than this limited warranty, WILI WILI TREE and its affiliates make no warranties, express or implied, and no warranties extend beyond the manufacturer's product description. The claims listed above constitute your sole and exclusive remedies against WILI WILI TREE and its affiliates, regardless of the legal basis. If a court finds a breach of this limited warranty, WILI WILI TREE's sole obligation shall be to repair or replace the product. If a court determines that this limited warranty has failed of its essential purpose, WILI WILI TREE will refund the original purchase price of the product.

Returns
Returns are accepted within 14 days (postmark date) of receipt of the product – undamaged and in the original packaging. Please include a copy of the invoice/purchase order. In the event of a defect in materials or workmanship, please contact us immediately at hello@wiliwilitree.com.

For returns, we will only refund the purchase price of the properly returned product – excluding shipping costs less a 10% restocking fee. Return shipping costs are the buyer's responsibility. If items are returned without justification (e.g., discounted items, damaged items, dirty items), WILI WILI TREE AG reserves the right not to issue a refund in cases of hardship. A maximum of 50% of the sales price will be refunded, less a shipping and handling fee of CHF 25.

Changes
WILI WILI TREE AG reserves the right to amend its General Terms and Conditions of Sale and Delivery at any time by publishing them on its website (www.wiliwilitree.com).

The place of jurisdiction is Bern. Swiss law applies.
